Richard Scrushy, the former CEO of HealthSouth Corp. has seen the trial judge throw out a Sarbanes-Oxley charge against him. U.S. District Judge Bowdre also dismissed a charge of obstruction of justice. The dropped SOX charge related to financial certification. Scrushy, however still faces 36 other charges including fraud. Life imprisonment, and millions of dollars in fines are possible if the trial goes the wrong way. Unlike Bernie Ebbers, Scrushy decided not to take the stand in his own defence. He acknowledges the fraud took place. However, he denies orchestrating it, blaming his CFOs and in particular Bill Owens. 10 money laundering charges remain on the charge sheet against him. |
